Personal injury claims are a confusing and daunting experience for anyone to have to deal with. Having had an accident or suffered an injury as a result of someone else’s negligence, the last thing you need is to be stuck with legal representation that does not suit your needs. Representation that not only were you not given the opportunity to choose, but that you feel you also have little option of refusing.

Every single Claimant has the right to choose their own legal representative. This is irrespective or who your insurers are or what anyone else might suggest to you.

It is often the case that immediately after an accident or when you start making enquiries into bringing a claim following an accident, you are steamrolled into signing with a Solicitor without being advised that you do, in fact, have a choice as to whom you use. Most people then follow the recommendation of the insurers or car hire provider and are not given the opportunity to research the best option for them. This is easily done immediately after an accident when you may not fully understand what is going on or what you are being told with all of the new terminology being used.

Other times someone will contact their legal expense insurance to enquire about a claim and be advised that they have ‘panel’ firms of Solicitors that their details will be passed to. These panel firms are not always the best firms to represent your interests and what is not explained is that legal expense cover can be used by other Solicitors’ firms, even if they are not a part of the insurers ‘panel’. Often the panel firm in question is located miles away and therefore leaves you with no option other than to have a telephone relationship with your Solicitor.

Even if you have instructed Solicitors, if you are not happy with the services that are being provided, your freedom of choice remains and you always have the option of approaching another Solicitor to take on your claim. This right doesn’t change once you have appointed a Solicitor and remains for the life of the claim. If you wish to change Solicitors then sooner is always better, but this can be done at any time and we at Metcalfes have a lot of experience in dealing with transferred claims where the Claimant has been unhappy with their previous legal representation. So, do your research and make sure that the person you are instructing to help right a wrong in your life is someone in whom you are happy and confident to put your trust in and not necessarily the first person that you are passed to.
